Group of EB3 & EB2 folks should take an appointment with DOS Chief first and then with USCIS's Chief. How can we do this ?We will discuss our concerns or interpretations and changes to work towards to clear backlogs or increase Quotas or Visa Recapture..etc. I am in for any group's concerns though I am in EB3.Category does not matter. India is the hardest hit in EB based Immgiration. Let me know How we can get to the attention of the TOP/Key Persons.

Employers can (at least they do) discriminate EAD holders. Here is an example and related link:

They key word here is "Permanent legal right to work in the United States". EADs (485 based EAD as well as F1 based EADs) have a limit of 1 year/2 year/29 months etc. Based on this Fog Creek Software will not hire an EAD holder. Can we do some thing about this blatant violation of the law?

Yes, case was originally filed at NSC on July 2nd and on august 24th it got transferred to TSC.
Does the transfer matter here, because dingudi's case is not a transfer case and he's still waiting...
not sure how far its true but came across some posts on http://www.immigration.com
stating that transfer cases from NSC-TSC are facing some delays in FP (even after SR) compared to NSC-CSC-NSC cases. heard couple of success stories with SR from NSC-CSC-NSC cases.
I'm also in the same boat, haven't opened SR yet.

Technically, we are applicants for immigrant status who are stuck in non-immigrant status indefinitely. A prospective immigrant is different from one granted legal residency (GC holder). Not sure if it makes a difference or not in the eyes of congressmen.

I love my country and want to go back, but it is in the hands of rapists and looters and I suspect it will remain that way...either I become a Gandhi and spend my life liberating it, or live year with my eyes & ears closed...
It is actually funny to watch you guys fight over the US vs India.
Let me ask you this:
-If you didn't choose to study medical or IT and never came to US, would you be thinking the same (problems in India and reasons not to settle in India etc) as you are thinking today?
-If US government didn't have the provision of employment based GC, would you be thinking the same as you are thinking today(problems in India and reasons not to settle in India etc) ?
The answer of the questions above is either YES or NO. I'm sure that many of us will answer these questions as NO.
And if the answer is NO and and you are still counting problems in India and trying to justify your stay in US, then I'm afraid my friends you guys are being opportunistic.
No matter how bad it is, that country made you capable of using this forum. You shouldn't backbite and find problems and issues in that country. You should rather use your energy in solving problems in India. Don't say it is not possible. Nothing is impossible.
You can send emails/letters/flowers to senators and officials here for GC, but I'm sure that there will only be handful of you; who actually tried to send their feedback complaints to Indian government and its officials.
I can go on and on, but I leave this thought with you guys and end my post here, as I know that you got the point.

what would happen at that time?

what if they issued FP notices but not issued EAD and/or AP.
would they still issue an EAD and AP even if your dates are not current(obviously the case was received by them and they issued you a case number)

I think the answer is yes, we will get our EAD and AP.
USCIS only looks at your PD while they issue case number (when you file for 485) and next when they approve your case (they issue your GC)

Thats YOUR perception, and its totally inaccurate. When xyz had his Eb-3 140 approved, by definition he was OK'd to be immigrant. Now that date belongs to him and if he has gained sufficient expertise/skill level for him to promote to Eb-2 I-140, the transfer of dates is obvious. On the contrary he deserves to be ahead in line because he had already filed Eb-3 way ahead in advance. Calling him an unskilled, inept, or lazy proves him otherwise.
When xyz had his Eb-3 140 approved, by definition he was OK'd to be immigrant in that category with THAT date. When he files for an EB2 he is "OK'd" to be an immigrant in that category at THAT date. Does not mean he should get to be at the front of the line just because he is now eligible for an eb2 job.

I completely understand your pain. I have been here since 1998 and have a EB2 PD of 2002. And the dates are back to 2000. It seems like I can never get the ducks in a row. First my case gets stuck in PBEC. It take me 4+ years to get out of it. Then the RD at NSC is not current. When the RD turns current the PD retrogresses. Off course not to mention that I am waiting for name check to clear. The process is not linear. Some ppl are able to get thru it all in a very short time and some are stuck for years and years.
I have gone thru some of the depression that you talk about. The only way out for me to realize was that either I take it or leave it. That's how I view the whole process. If I am going to take it then I need to have a plan for what I am going to do with my GC. I know one thing for sure, I am going to take a long vacation as soon as I get it :) Just getting too old and tired for the same old same old.

The US has been very good to me (other than the GC part), more than my home country (India) which is why I'm still here.
Have invested too much of time in this country to just pack up and go. Just curious if any of you feel this way? How do you handle such depressing feelings?

2) Filled 7001 form for Ombudsman - waiting for reply
3) Called USCIS 10 times in last 10 days and come to know that everything is cleared on my and wife applications. - everytime they tell someting diffrenet .
its shows how USCIS work ... as if everything is cleared our 485 should be cleared .
can't take infopass ( no option to check case status) or open SR ( as its not beyond 30 days) .
