If country-cap is meant to promote diversity, it should be based on percentage of each ethnic group in US population. Indians and Chinese are a minority in this country.

There is not much use for just fighting EB3-I. You can send a letter or lobbey and they will hear it. Thats all. There are so much discrepancies in immigration policy of USA(The impact is for just for potential immigrants not for the country) I do not think they will spend time to resolve each and every small discrepancy. There are more more severe issues in the country than resolving EB3-I. Of course that is a big issue for those who are impacted.
But the problem will be automatically resolved if STEM/and or Recapture bill is passed. That is a big picture and that will get more attention than just lobbying for EB3-I.

It is very very difficult to convince anyone to overflow EB2 ROW -> EB3 ROW -> EB3 I (leaving EB2 I out of loop). (eventhough USCIS did it in past)
If someone tries to re-interprete, it will end up like:EB2 ROW -> EB3 ROW -> EB2I -> EB3 I, still no real benefit to EB3 I; only EB2 I will loose with some benefit to EB3 ROW.
Bottom line is, we need more visa numbers and that's what we need to campaign for. May it be recapture, or STEM exemption or anything else.

I think you will get in less than 2 years. It will not take 10 years. Hang on. Total GC process time from applying to labor to getting GC usually is 4 years. some unlucky people had to wait more than that. But more than 80% fall in to 4 year time line.

Thats not true. My PD is March 2005. When my PD comes, I have to apply for EAD whereas others will get GC. Oh such a screwed up system.

Finally we have decided to go back to India for good. I filed my EB3 in May 2003. Its going to be another 4 years to get the green card. When I went to India for vacation last December, we liked it over there & the economy is booming. There are all sorts of discussion regarding the Economic Gap/Politics/Corruption/Cleanliness. But we like it over there. Finally I will have an option to do something interesting. In US I was very much dependent on my monthly pay check and afraid to take even the slightest risk. I am also scared to use the AC21(Hey, thats the way I am). I am working with the same company for last 10 years, kinda stagnant in the last 4 years. In India, there are lots of choices, either to work for a sw company or start some business on my own. I think I will take the business route.
May be I can go there, earn well, send my son to US for college, do green card through him & come retire in US!!!

You can download the form from SSA website and fill the information for each applicant and take it to the SSA office. You can get rid of 'authorized to work with INS permit only' label of your SS card by using the same form and get a new card.
Take the forms, your PR card, old SS card. It just takes few minutes. They will take the info, shred the old cards, forms, etc. and will mail the cards to your address...Just check other thread ' Dos and Donts after GC' fo rmore info, and open a separate thread so as to not to mix up the original content of the thread...

I am an EB3 (so go ahead with your Red dots!)...
For any lawsuit, there needs to be a basis. What is the basis of your proposed lawsuit?
It has been standard operating procedure to process applications on a FIFO basis, subject to some granularity. People who feel they should get their GCs first because their PDs are older are sadly mistaken. Processing by USCIS is based on RD/ND. Not PD. So any lawsuit complaining about PD-FIFOs is not going to fly.
I highly doubt that any lawsuit which complains that NSC is slower than TSCs is not going to fly either. Each Service center has certain amount of staff, and allocation to jobs, they will be some discrepancy. If someone is able to make a lawsuit stick on this basis, let us know, we will build a avalanche of lawsuits because labor was not being approved in an orderly fashion in 2001-2004 time frame, all of which will then have a direct impact on all the 2004-2006 filers.
Go ahead and help us out. File your lawsuits, EB3s will join the party with our own lawsuits.

Any comment from anyone?
Wanted to know what the members here think of the probability of receiving RFE from USCIS to find out whether the applicant is still in a "same or similar" job when the time comes to adjudicate cases for for EB3 India.
I ask this because in a poll conducted in a separate thread, it seems the number of people waiting for their GCs are more with PDs before Dec 2004 than after that date.
When the dates become current again for these people, do you think USCIS will be sending RFEs to get the employment information for every single of them ? Is there is a percentage from the pending applications that they pick for RFE, assuming all applicants who changed employers DID NOT notify USCIS when they changed jobs OR is it completely up to the whims of the adjudicating officer to send an RFE ?
There are several people I know who changed employers with EAD, never notified USCIS and got their GCs without any RFE. Trying to understand whether USCIS will think twice before sending RFEs for everyone as the number of applicants waiting with PDs of 2004 and earlier are huge now than ever before. Won't it be too overwhelming for them to issue RFEs to all and manage their responses?

Well there is a lot of media attention already. I've been talking to so many reporters and there was a huge interest in the event.
Tomorrow, there will be a bunch of media people at USCIS to talk about this, yet in the entire DC area, only nixstor is available to go to USCIS.
How can we expect major media to cover us when we are not willing to participate in something that is of benefit to us?

I am not sure about that. Most of the EB3 guys have advance degrees (including me) but not necessarily with US degrees.
I would not agree that most folks in EB3 have advanced degrees. Most do not. They have lot of experience though
believe me...you would think that people with advanced degrees would have applied in EB2...but there are cases where people have had to apply in EB3 category even with an advanced degree
I disagree with this too. Here are a few examples
1) A couple of years ago, when there was no retrogression, most folks did not want to take a chance and thought EB3 was a safer bet
2) Many Advanced Degree holders from US Univs joined a firm and their GC was applied immediately. But since they did not have enough work ex, they applied in EB3
3) Lots of scrupulous employers heard about retrogression and were actually very happy. They purposely filed even highly qualified folks as EB3 so that their abuse can be prolonged
4) Incompetent lawyers who felt they would not be able to prove the necessity of EB2
5) Sheer ignorance on the part of the beneficiary

Thank you Aman & all the other immigration voice members who have spent so much time, energy and resources in advocating on behalf of all of us. I have been working in the non-profit sector for the past 8 years and from experience suggest that in order for this movement/advocacy campaign to sustain it is important for us to have a system in place where core campaign members are reimbursed for their past and recurring expenses. We have contributed to IV previously and would like to pledge $200 towards Aman's expenses.
