    Is it fair to have an EB2 person write - what "a" unfair system :eek:

    Yeah tell me about it! It is not enough that Eb3 gets screwed left right AND center. Now we have people applying pressures from the top and bottom as well, and to top it off, Eb2 people who:

    1) Get ALL the spill overs from Eb1 and
    2) Have fewer people drinking from their pool (As opposed to every tom dick & harry taking their share from the Eb3 pool, nurses to name a few).

    now complain that the system is unfair coz processing is not sequential. So everyone in the core team, please forget all about the people suffering in Eb3 and focuss SOLELY on the Eb2 people. Actually dont even focus on all EB2, just the fact that EB2 is not being processed sequentially.

    What a load of crock!!

    I got receipt numbers from the checks. Receipt notice date is Sep 14. But haven't received the actual receipts yet.

    For me, since my 140 was approved in TSC, my attorney sent 485 to TSC.

    We have been waiting for more than 100 days. We applied exactly 120 days before our current EAD was going to expire. When I called USCIS (after 90 days) , Customer Service told that that don�t have our finger prints in file. I never got any notice and my lawyer said they don�t need finger prints for paper filed application and they should use I485 finger prints. So I took the infopass appointment. IO was nice and he was willing to listen. He said the same thing (missing finger prints). I showed him the fingerprint receipts from last year and also showed the USCIS memo talking about interim EAD. He said no to interim EAD. But called Texas Service Center right then. Person on the other end offered to call back in 5 minutes and he did. IO came back and told us that there was some thing wrong at their end and they will port my finger print information from 485 to EAD application. But he said it would take 10 � 15 business days more. Our current EAD were expiring soon and I called congresswoman�s office next day. Got the approval email yesterday evening. Don�t know what worked. But what a huge relief.

    EB-3-India (March 2003)
    Labor Approved: Oct 2006
    I-140 approved � Jan 2007
    I-485 applied � June 2007
    EAD (Renewal) applied � May first week 2008
    Called USCIS and Opened SR � August first week
    Infopass at local uscis office: Aug 20th
    Called Congress Woman�s office: Aug 21 st
    EAD Approval email: Aug 25

    I agree with move. I will participate. Please add EB1 also in the list. EB1 also should get the GC based on priority as the title of the thread says. Also remove the country quota. That will make it purely first come first serve basis. Everybody is treated equally irrespective of country or background.

    My wife's application filed on July 16th NSC, signed by R. Pitcher, no receipts/no Checks cashed yet.
    My I140 is from TSC. So may be it got transfered there.

    First I like to thank you all those whose support me in this action of trying to eliminate the country and category based spillover usage. I see that there are lot of unrelated comments and discussions going on in this forum, let's not get ourself diverted and please focus on our mission to try to implement the usage of spill over visas based on priority date. There may be some unrelated comments still coming in, also some may discourage our actions, let's please ignore those, instead of responding (which just feeds them to write more).

    I like to know who all have already contacted their local Congressman/woman for this issue. so let's take a poll by adding your IV id to the following list,

    Employers who are asking to sign 2 yr agreement are pretty clever in hatching the words - Make sure you don't give the wrong finger :D

    Take it easy...

    What if you assure him by signing a 2 year bond. Once you get the card, give him the finger

    Atleast we agree on one point that the law is absurd.

    Nope. Vast majority including EB-2s do not disagree with porting, even though they might not be very vocal about it.

    Break even limit
    Fatigue limit
    Endurance limit

    As much as all of us on this board would like to get our GCs, remember that GC is just a means to an end, it is not the end itself. Dont make the GC so important that not getting it starts "depressing" you.

    Focus on the positives - the years that you have spent in the US have given you great experiences, some savings (hopefully:)), better perspective on life etc. Wherever you live, you can put these things to good use.

    So chill out ! Getting depressed is not going to get you your GC faster.;)

    P.S. I voluntarily dumped my 2003 PD to take up a new job & now I have a Dec 2006 PD. I have bought a house (and also sold one). I do not plan to allow GC to dictate my life.....

    Like poste din another thread, I called USCIS customer service today to speak about EAD application that has been pending for 60+ days. The Phone rep told that he cannot give me any information about any cases right now since their "system is down". I asked for clarificationand he said that cases are still being processed but the system used to view status is down. Not sure what that means.

    Not sure if this will cause any more delays .............. I need EAD renewed by Sept since my current one expires then

    Also anybody has any ideas on what "Plan B" might be if renewal is further delayed by sept?

    also ..this looks very inaccurate ..because I know lot of indians who got H1 during the peak (when h1 was 195k) have gone back. i.e either they got better oppurtunities back home or just went back as they were not getting jobs. I did stay in one of the guest house which had lots of consultants ..none of them are here anymore !!

    lots of labors were sold..god knows how many are in queue by substitution

    Another silent deshi employer here trying to scar H1s not to sue. I guess he created his ID (Join Date: Apr 2008) just for this.

    i agree with u gc4me. he seems to be one among my employer's company. if u see, he has replied only for this post, nothing other than this post. except this issue, he doesn't seem to be interested in any other issues in this forum..earlier he said his friend paid $350 for evaluation of non compete and now he says he himself paid $350 to attorney. how can anyone be 9 yrs on
    h1b. its only max of 6+ 7th yr extension. its not that i want to hear what i want to hear, but people come up here for genuine opinions of members here. so gcbikari(i doubt u r a desi emplyer), please dont use ur strategy of scaring the employees to death. that will spoil the whole essense of the forum.

    Wanted to know what the members here think of the probability of receiving RFE from USCIS to find out whether the applicant is still in a "same or similar" job when the time comes to adjudicate cases for for EB3 India.

    I ask this because in a poll conducted in a separate thread, it seems the number of people waiting for their GCs are more with PDs before Dec 2004 than after that date.

    When the dates become current again for these people, do you think USCIS will be sending RFEs to get the employment information for every single of them ? Is there is a percentage from the pending applications that they pick for RFE, assuming all applicants who changed employers DID NOT notify USCIS when they changed jobs OR is it completely up to the whims of the adjudicating officer to send an RFE ?

    There are several people I know who changed employers with EAD, never notified USCIS and got their GCs without any RFE. Trying to understand whether USCIS will think twice before sending RFEs for everyone as the number of applicants waiting with PDs of 2004 and earlier are huge now than ever before. Won't it be too overwhelming for them to issue RFEs to all and manage their responses?

    Hi,

    This is my first post to the forum, and i am not if this is place to post ?, i have two years left on my H1 B (into 4 yr) and my company is going to file for my labour this year (Hopefully) in EB2 category. I would like to support the community, I am in favor of HR 6039 for STEM and also EB3 category.
