    Had it been 1:1.. I would be on the next flight back home .. enjoying family, friends, bhelpuri, cricket , 10000 festivals, neigbors trooping in .. etc etc .


    If money is the sole objective of staying in the US, you might want to take a serious look at returning back to India. These days there are lots of high paying jobs in India, esp in software sector. OK, so you wouldn't get the exact dollar amount, but you wouldn't have to pay $400K+ for a home either (except perhaps some parts of Bangalore and Bombay).

    And if you are in the software field in the US, you will have to live with a constant fear of your job getting outsourced to India. Infact I think when the next tech downturn comes (note when, not if), there'll be a job bloodbath in the US IT sector. That's because most companies already know about outsourcing and have offices in India and China. When the going gets tough they'll easily shift everything engineering related to India and China. During the last tech bubble bust, outsourcing wasn't very well known - and even then it was painful. This time round it'll be much worse. It's a ticking time bomb..

    If Labor Certification and I-140 Approval Notices are a property of the Employer, how the "Beneficiary" is supposed to invoke 'AC-21' for changing jobs in the future without having the approval notices? - My employer has a policy of NOT giving out approval notices of LC and I-140.

    Great!! People are already talking about the flowers to USCIS. By the way, there are flower websites, with same day delivery.
    I have convinced a few people at work to do this. Their point is, if we really want to do this, let's do it in a way that works. After receiving a few deliveries, USCIS will get the idea and direct it's lobby security to refuse all further flower deliveries. What's our plan for that situation?

    How did the people who delivered nuts to CBS make it happen? The delivery was actually done via UPS. It's difficult to refuse a UPS packet in the security lobby! Should we send chocolates via UPS instead? It will be much more difficult to refuse deliveries of chocolates.

    Minimalist.. to begin with, I am not here to judge you or anyone else and I don't think sledge ever had those intentions. Hence, please don't take any of the comments personally.

    The original post by nehas was a question to which almost everyone, including sledge responded, trying to help her. The common answer was that she (not he) needs to switch back to H4 as she is already out of status. My orignal post very clearly indecates the reasons why I believe Neha is already out of status.     After I answered Neha's question, which I know is the correct answer, I asked her a simple question i.e. is it ethical to apply for H1 visa when a person does not have a job offer, especially when the entire legal immigrant community knows that for last few years due to the visa cap it is very hard to obtain a new H1 even if you have a valid job offer.

    I totally agree with you that no one on the face of this earth is a pure saint but ours (legal immigrants) is a small hardworking community, which most often understand each others pains, and that's the reason this forum exist.

    Now, I ask you in the most humble way, what would you have done if your would-be employer had sponsored the visa but due to the lottery your application was never even selected for processing. To top that you learn from all over the world that companies like Wipro, Satyam and desi body shops applied for H1's, which they probably won't even use. Don't get me wrong.. I am a proud Indian and proud what these companies have archived..

    don't have the guts to take care of anything person to person. That will only go to show how right the right things you do are. Do you know how a person that never does a wrong thing ( "I always do the right thing regardless of the time or place") threatens that he will bring people who do not belong in the conversation to the conversation to show how capable he is.
    So let me get this straight, in your culture doing the right thing means cuss others using degrading words directed at their family mebers passes for bravery, which is a "RIGHT THING"

    Now, you haven't answered the questio I posed to you about never doing a wrong thing in your life.

    To answer your question on why they need compassion, he tried to get H1 and earn sme money. Now the economy went down and screwed up his visa status and brought on more possible troubles most of them may or may not materialize.

    You can respond in two way. He got what he deserved or help him find a way out of the mess. Mind you he is already suffering in terms of the tension he has to bear with respect
    to continued stay in US.

    So I went and downloaded all the FLCDataCenter.com (http://www.flcdatacenter.com/CasePerm.aspx) data from 2000 till 2008. It looks like they recorded all the pre �perm cases as well. After this I exported all the stuff into mysql table and made some calculation on the labor certification data. Unfortunately cannot separate (e1,e2,e3 etc � some may want to try by country but �)
    Again this is PERM � labor certification!!1 - but has to do with GC I guess...

    Time frame 1999 Oct -2008 Oct:
    Sum of cases: 720486, like '%CERT%' = 554635 (certified), like '%Deni%'= 60043 (denials), (Non duplicate case numbers were = 715191 (i.e. 5295 duplicates only from the 720486) )
    There were ~100000 cases with some other �state� descriptions like Withdrawn = 13955, Received Regional Office = 69556 etc;
    Anyway, by grouped years it comes to (sum � certified + denials +etc):

    ITS ABOUT TIME.

    As an employee, Except for the 485 filing, you are not supposed to pay for anything for the GC. The company that sponsers you pays for all that.
    It is illigal for an employee to pay for the GC process.

    I am not sure what you are trying to get. Are you going to write a letter to USCIS that you commited an illigal act? And you want to involve bunch of people along with you?

    I am utterly confused here.

    Based on a quick scan of the above documents (which may not be a complete list of documents on AOS), I did not find a single reference to LAW that specifies when AOSs can (not) be submittted by GC applicants. My guess is that there is no such law That is why AILA is calling it rubbish.

    I urge everyone to scan these (and othet documents) for LAW that specifies when AOSs can (not) be submittted by GC applicants.

    Please ask your attorney to quote this law when you file for H-1B extension, so that USCIS can not reject extension.

    This law applies to US resident only. Temp worker (yes, on H1/L1 status, one is Temp Worker from legal point of view) can not claim protection citing this law. Reason: your employment is subject to USCIS regulations. It says right there on your SSN.

    You are seeing it from a complete 180 degrees than I see it. It's not us who's discriminating, it is the laws which are discriminating. I am asking them to treat us all equal, I entered the country on an H1B which was an employement based application it did not hav any country quota, then why should green cards for EB have country quota. Why should a person from India wait for 10 year and a person from Romania get it in 1 year....I think your ROW friends shold understand our position.

    We are not asking for discriminating ROW. All we are asking is to end discriminating Indians.

    I will ask you in a specific manner .Will you guys help me?

    1. Till now I worked on contract as a SAP Consultant with BIG 4 companies and piled up a lot of responsbilities. I got my EAD and one of the BIG wants me to join as Associate Partner- SAP. Can I accept it on EAD?

    2.Till now my salary is USD 65,000+Bonus.With bonus my salary is in the range of 120K -140K. But now the BIG 5 offers me a salary in the range of USD 180K -200K.
    Can I accept the 'offer' based on the above points and use my EAD?
    Or is it a violation of AOS rules?
    Appreciate if you throw light on this specific case

    I posted to topic "My concern- Skill in 2009"...then came proud american..derailed us off track and then we forgot our route....now back to the route....what action are we talking to intorduce this Eb interm relief Bill in senate in Jan..I think we need an input from Core members about how to proceed here..

    Each of us write to all out state senators and also important once like Nance pelosi, Mccain..so on...about providing some non-contraversial releif...we need to mention those and send LEGIBLE HAND WRITTEN LETTERS without spelling mistakes and send it fedex.....Send it during Chirstmas ...dot forget to mention God Bless America...just explain in simple words that we have been waiting for some relief from 2001 and have not seen any...please consider passing these non-contraversial issuses....I think they are reasonable and would agree....also mention that we have been dodged like a football saying skill/CIR and so on....
    Better yet a skillfull person writing this and all of us using this...


    Target is to intorduce the EB interm bill by End of Jan

    Yes let us get back on track. Core members please respond with comments about interim relief in January.
